TrueStyleAI — Customer Terms of Use

TrueStyleAI Limited (“TrueStyleAI”, “we”, “us”) provides the TrueStyleAI website and web application (“Platform”): you scan a QR code at a participating barbershop or salon, create or log into an account, upload a selfie, receive AI hairstyle suggestions, choose a style, and see an AI preview image. Your selection and related details are then sent to your barber, stylist, or salon so they can provide the service. Your haircut or salon service itself is provided by the barbershop or salon — see clause 4.

These Terms of Use (“Terms”) are an agreement between you and TrueStyleAI and apply to your use of the Platform. By using the Platform, you are deemed to accept these Terms.

We reserve the right to update these Terms from time to time by providing notice (within the web application or by email). Your continued use of the Platform following such notice will be deemed as acceptance of the updated Terms.

We may put limits on your use of the Platform including data storage and the allowable number of requests for AI suggestions and previews.

We may immediately suspend or close your account for serious or repeated breaches with or without notice.

You agree to indemnify TrueStyleAI from and against any loss, damage, liability, costs or expenses (including legal expenses) suffered or incurred by TrueStyleAI, in connection with any breach by you of these Terms.

Only upload photos of yourself, or photos you have clear permission to upload from the person in them.

Do not upload photos of anyone under 18 unless you are their parent or guardian, or have their parent or guardian's consent.

Do not upload explicit, offensive, or unlawful images, or images of other people taken without their knowledge.

You confirm each photo you upload complies with these Terms. We may remove content that breaches these Terms, and reserve the right to suspend accounts that repeatedly breach them.

The haircut, colouring, styling, or other physical service is provided by the barbershop or salon you visit, not by TrueStyleAI. Your contract for that service is with the barbershop or salon, and we accept no responsibility whatsoever for the services of that.

TrueStyleAI is responsible solely for the provision of the Platform.

Artificial intelligence (“AI”) previews are illustrations to help you and your barber discuss what you want. They are not a photograph of the future and not a guarantee of the final result. We do not make any warranties or representations about the accuracy, completeness or reliability of the suggestions, previews or other information generated by the Platform.

Your final result may vary depending on your hair type, current length and condition, lighting, barber technique, tools, products, and salon conditions.

Suggestions are style guidance only. They are not medical, dermatological, or professional health advice. If you have a scalp or skin condition, talk to a health professional.

AI systems can make mistakes. Always confirm what you actually want with your barber before the service starts.

When you select and confirm a style, we send to the barbershop or salon of your choosing the following: your original photo, the AI preview, the style name, cut instructions (including guard/fade level), beard instructions (if applicable), and your selected services, along with your name/booking details.

You retain ownership of the photos you upload. You grant us a worldwide, non-exclusive, fully paid up, transferable, irrevocably licence to host, process, transmit, use, store, copy, display and make available that content for any purpose in connection with the exercise of our rights and performance of our obligations under these Terms.

You may save and share your own AI previews for personal use. Do not present a preview as a real photo of a completed haircut (for example, in a review) — that could mislead others.

We collect and treat personal information in accordance with the Privacy Act 2020. More details about when we collect personal information, what we collect, and what we do with it, can be found in our Privacy Policy www.truestyleai.com/privacy-policy/.

We aim to keep the Platform available but do not guarantee that the provision of the Platform will be uninterrupted or error free.

We reserve the right at any time to, and from time to time may, modify, suspend or discontinue, temporarily or permanently, the Platform for any reason or no reason with or without notice. You agree that we shall not be liable to you or to any third party for any modifications, suspension or discontinuation of the Platform.

Nothing in these Terms excludes or limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

To the maximum extent permitted by law, we exclude all liability in respect of any loss of data, use, or any indirect, incidental, special or consequential damages incurred by you or any third party, arising from your access to, or use of, the Platform. We are not liable for any claims, liabilities, damages, losses or expenses you or a third party incur that are outside of our reasonable control, including as a result of or arising from any unauthorised access, deletion, modification or disclosure of your content by unauthorised actors, our use of third party applications, or any event outside of our reasonable control.

Our maximum aggregate liability to you in all circumstances is limited to the greater of (i) the value of fees paid or payable by you in the 12 month period immediately preceding the event giving rise to such liability; or (ii) NZ$150.

If you encounter any issues with the Platform (such as account access, previews, data, or billing), please contact us at [email protected]. We aim to respond within 5 business days.

Any problems with your haircut or salon service should be raised directly with the barbershop or salon responsible for the service.

You can close your account at any time in the app or by contacting us. Closing your account triggers the deletion process described in the Privacy Policy.

We may assign your account and the Platform to any third party as long as this does not affect your rights under these Terms. You must not assign or otherwise transfer your rights or obligations under these Terms to anyone else without our prior written consent.

If any part of these Terms is found to be unfair or unenforceable, then it will be modified so as to be fair or enforceable (as the case may be), or if modification is not reasonably possible then it will be treated as deleted from these Terms, and the rest of these Terms will continue to operate.

If these Terms end for any reason it does not affect any rights and responsibilities which are intended to continue or come into force afterwards.

These Terms are governed by New Zealand law and the New Zealand courts shall have exclusive jurisdiction over any dispute arising under them.
